City of Aspen v Colorado Union of Taxpayers

Issues in this case concern whether a bag fee charged by the City of Aspen is a disguised tax intended to influence consumer behavior and if the TABOR standard of review in deciding whether the levy of a charge without voter approval violates the constitution.
